NOTICE OF SALE:
By virtue and in execution of the Judgment Order and Decree of Foreclosure and Replevin and order for Public Sale Involving Lien of the United States under 28 U.S.C. Section 2410 dated April 3, 2007 and recorded in the Cambridge Land Records, for breach of the mortgages as stated therein, and for the purpose of foreclosing the same, NOTICE IS HEREBY GIVEN that on the 28th day of June, 2007 at 11:00 a.m., at the land and premises known as 78 North Main Street, Cambridge, VT 05444, the Thomas Hirchak Company, on behalf of the plaintiff, the Union Bank will sell the real property and improvements thereon, as further described in said mortgages (the “Property”), at public auction, “AS IS, WHERE IS” with no representations or warranties of any kind, to the highest and best bidder for cash, and subject to any and all current and delinquent real estate taxes and municipal assessments, including late fees, charges and interest, for which the successful bidder shall be fully responsible. The property shall also be sold subject to the right of the United States to redeem the Property on or before six months from the date of sale, if its tax lien has not been discharged prior to or as a result of this sale. At the sale, the successful bidder shall be required to deposit at the time of sale with the Thomas Hirchak Company or its representative a minimum of ten (10) percent of their bid, although a smaller percentage may be accepted at the discretion of the Union Bank, or its representative, provided that the remainder of the ten (10) percent a minimum of Twenty ($20,000) Thousand Dollars is deposited within three (3) business days from the sale.
The legal description of the property foreclosed upon can be found in the mortgages filed in the Cambridge Land Records and all deeds and instruments of record. The physical address of the property is 78 North Main Street, Cambridge, VT 05444.
The mortgagors, James P. Colaceci and Linda P. Colaceci are entitled to redeem the property at any time prior to the sale by paying the full amount due under the Judgment Order and Decree for Foreclosure and Replevin and Order for Public Sale involving Lien of the United States Under U.S.C.
